Cuba Man Charged With Aggravated DWI, Property Damage

A Cuba man allegedly struck a cable barrier at Wallis Oil Company while driving intoxicated Dec. 18 in Cuba

Justin Ware, 40, has been charged with aggravated DWI and second-degree property damage.

Ware has been convicted of DWIs in April 2008, October 2017 and November 2017.

The probable cause statement alleges that around 12:50 a.m., officers responded to Wallis Oil Company to find a Ware, who had struck a cable barrier in the parking lot.

The cable became entangled under Ware’s vehicle and he was attempting to leave the area.

Ware told officers he wasn’t driving and that his “buddy” was. Ware, who smelled of alcohol and struggled to maintain balance, said he didn’t know how the truck hit the barrier. 

He also refused to show his license as he claimed he wasn’t driving.

Ware was placed under arrest and taken to the Cuba Police Department.

Ware refused to submit to a breathalyzer, but officers received a search warrant to draw his blood.

Ware was taken to the Crawford County Sheriff’s Office, where he told the officer to “charge (him) with the felony because nobody is drawing (his) blood.”

Ware was placed in a restraint chair and balled his fists to resist, though EMTs were able to draw his blood.
